The following Terms Of Service (hereinafter referred to as "Terms") are valid between you and ROTATE SYB (hereinafter referred to as "ROTATE", "Us", "We", "Our") and apply to all use of our services offered through ROTATESYB.com (the "Website", "Site") and associated sales channels, our mobile application (the "App"), or any of our team members.  We offer this website (hereinafter referred to as "Site"), including all information, tools and services available from this site and related sales channels to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site to use our service and creating an account, you agree to be bound by the following Terms, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site or any other sales channels used to sell our products, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.  If you do not agree to these Terms, please do not continue to use the Site.  

Please read these Terms carefully before accessing our site or using our services.  By accessing or using any part of the site or services, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the site or use any services.  If these Terms are considered an offer, acceptance is expressly limited to these Terms.

Any new features or tools which are added to the current store shall also be subject to the Terms. You can review the most current version of the Terms at any time on this page. We reserve the right to update, revise or replace any part of these Terms at any time.  It is your responsibility to read these Terms prior to using our services or visiting our site.  Your continued use of our services or access to the site following the posting of any changes constitutes acceptance of those changes.

We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.



SECTION 1 - REQUESTING OUR SERVICES

You will need to create an account to use our services.  You are only allowed to create one account.  The creation of more than one account may result in permanent revocation of your right to continue use of our services.  

By listing merchandise on ROTATE, you confirm you are the rightful owner of these products and give us permission to offer and sell these products on your behalf.  

By adding products to your shopping bag or asking us to contact a seller to inquire on a product on your behalf, you authorize us to engage in activities that may lead to a sale on your behalf.  

We will not be liable to you or deemed in breach of our agreement with you should a seller delay the shipment of an ordered product or your order is delayed due to circumstances outside of our control.  

We reserve the right to refuse our services to you at any time and at our sole discretion.  

When you place an order with us, you agree to be bound by, and accept these Terms.   

 

SECTION 2 - ACCESS TO AND USE OF OUR SERVICES

By agreeing to these Terms and your use of our Site or related sales channels, you represent that you are competent to give ROTATE rights as detailed in these Terms and to comply with these Terms.  You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

When a seller consigns with us and list an item for sale on our platform, they authorize us to sell their products on their behalf in the condition and at the price as listed.  A seller decides whether to proceed with a sale and may revoke a sale order at any time prior to shipment.  Although we make every attempt to ensure that all information listed on our platform is accurate and up to date, ROTATE makes no commitment or guarantee regarding items listed on our platform, including the quality, availability or condition of the item.  We also do not guarantee that information regarding the price, description, condition and availability is free from error and up to date at all times.

You may be able to access third party links/websites/products via our platform.  ROTATE is not responsible or liable for any third party links/websites/products which may be accessed by you at your sole option. Your access to and use of such third party links/websites/products and services shall be solely at your own risk and subject to your acceptance and compliance with the separate terms and conditions of such third party.

To the maximum extent permitted by the law, our total responsibility for any claims relating to a sale transactions is limited to the the sale proceeds payable in connection with that a sale.

For any other claims arising out of the provision of the use of our services (including without limitation any dispute between users in relation to any content you access via the platform, or any other user you interact with), we do not accept any responsibility whatsoever (whether arising in contract, tort otherwise), except where we cannot disclaim, exclude or limit responsibility by law (such as death and/or personal injury caused by our negligence).

We will never be responsible for any loss or damage that is not reasonably foreseeable and we will never be responsible for indirect losses and/or financial and business loss, or loss of goodwill or reputation.

If ROTATE is sued due to an action or inaction by you (including a breach of these Terms of Service) then we have the right, at our discretion, to request that you indemnify us (i.e. cover all our costs including legal fees) and hold us harmless from any legal claim or demand for expenses or costs that arises as a result. Where we decide to conduct the defence of such claim, you agree to assist us as reasonably requested.

ROTATE  is not responsible or liable for any loss or harm caused by viruses, worms or other programmes designed to impair the Service.You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

 

SECTION 3 - PRODUCTS OR SERVICES

ROTATE is a global digital marketplace that allows sellers and buyers to connect for the sale and rental of merchandise.  Sellers can list their products on our platform by emailing images along with price and description to shop@rotateshopyourblock.com.  Buyers can purchase items from sellers by adding items to their shopping bag and chatting with a Personal Shopper via WhatsApp or iMessage when they are ready to complete their purchase.  When a buyer is interested in making a purchase of a seller's merchandise, we will contact the seller and facilitate the sale and deliver of the merchandise.  Sale transactions can only take place via the ROTATE platform.  

Certain products or services may be available exclusively online through the website or any of our other sales channels.  These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.  We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

 

SECTION 4 - PLACING AN ORDER

You may place an order with us by browsing our online store and making your purchase.  

 

SECTION 5 - YOUR ACCOUNT

When you register for an account, you will be asked to provide personal information such as your email and address.  Providing false or misleading information in your account profile will lead to the permanent revocation of your right to the continued use of our services. 

When you create an account, you will be required to create a password as part of our security policy.  Your password should be kept confidential and never disclosed to other parties.  You are responsible for ensuring that the information entered by you into of your account is accurate and up to date at all times.  Access to your account should be restricted to only you and you are responsible for securing the confidentiality and integrity of your account information including your password.   You are solely responsible for any unauthorized use and access to your account.  You understand and agree that you are responsible for all activities that occur in your account whether or not you authorize that activity. 

If you suspect that your account has been breached, you must notify us immediately at shop@rotateSYB.com.  

ROTATE reserves the right, without any notice to you, to limit or terminate access to your account or restrict your ability to shop with us.  

 

SECTION 6 - ORDER ACCEPTANCE AND CANCELLATION

When you place an order with us, your order is subject to acceptance by us and subject to the availability of the items in your order.  Orders are processed pending item availability and credit card verification.  We will contact you by email and/or text to confirm receipt of your order.  If you refuse delivery of an order, the package will be returned to the seller and all shipping and handling charges incurred will be deducted from the amount of your refund/store credit.  

Acknowledgement of your order does not mean that your order has been accepted or shipped, or that the price or availability of an item has been confirmed.   Before we process your order, ROTATE may in its discretion require additional verification or information before accepting any order.
We reserve the right, without prior notice and in our sole discretion, to refuse or cancel any order for any reason.  The following situations may result in your order being cancelled including, but are not limited to: invalid, incomplete, improper, or missing payment or shipping information; limitations on quantities available for purchase; inaccuracies or errors in product or pricing information; use of any robot, spider or other automatic device, software, process or application to place, or take preparatory steps to place, one or more orders; violation of these Terms; or actual or suspected fraud or abuse.

Prior to shipment, we will verify the availability and price of product(s) in your order.  If an item's listed price is incorrectly stated, we will contact you about the price discrepancy and allow you the option to pay the corrected price or cancel your order.  If the item is no longer available, or if we determine that there were inaccuracies in the product information, we reserve the right to cancel your order at our sole discretion and notify you of such cancellation via email.

 

SECTION 7 - RETURNS

All sales are final and ineligible for return.  

 

SECTION 8 - MODIFICATIONS TO OUR SERVICES AND PRICES

Prices of products listed on ROTATE are subject to change without notice.  We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.  We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

 

SECTION 9 - AVAILABILITY OF PRODUCTS AND SERVICES

We make every effort to ensure that our inventory is accurately reported, however, we and the seller may from time to time make errors in the reporting of our available quantities.  Should you place an order for a product that is out of stock, we will contact you immediately by email and/or text and process your refund.  

Although we intend to have our services available as much as possible, there may be occasions when our service may be interrupted, including for scheduled maintenance, upgrades and emergency repairs, or due to failure of telecommunication links and/or equipment.  Our services and any content contained therein is provided on an “as available” and “as is” basis. This means that we are unable to promise that your use of our services will be uninterrupted, without delays, error-free or meet your expectations and we do not give any commitment relating to the performance or availability of our services in these Terms and, to the extent we are able to do so, we exclude any commitments that may be implied by, or be expressed by, applicable law. You accept that the internet may be subject to breaches of security and that the submission of our content or other information may not be secure.

 

SECTION 10 - PRICING AND PAYMENT

The price for all goods will be as stated on our site.  Sellers have sole discretion to set their own prices and can change such prices at anytime without notice.  The prices displayed on the site are stated in U.S. dollars, GB pounds, EU dollars and CAD dollars.   Sellers may lower their prices at any time prior to the sale of their merchandise.  Prices do not include sales tax or VAT, where applicable, or delivery charges, both of which you agree to pay when placing your order.
SECTION 11 - YOUR CONTENT
You confirm that all images, content or other information that you submit to us is your own or you have the right to the use of this information.  By submitting this content to us, you grant us all irrevocable rights to the use of this content for our purposes in the course of our business operations.   

We review all content submitted to us for use on our platform.  Any content not deemed appropriate by us, will not be accepted for listing on ROTATE.  Kindly note that we are not liable for any loss of this information.  

 

SECTION 12 - EXCHANGES

Exchanges are not allowed.  

 

 

SECTION 13 - INTERNATIONAL RETURNS

Same policies for US returns applies to International returns.  

 

SECTION 14 - SHIPPING POLICY

Domestic - ROTATE offers standard shipping via USPS and UPS on all US orders.   We ship worldwide via UPS and DHL, depending on the item ordered and the destination.  The delivery time of your order is dependent on the carrier.  Please see our Shipping Policy for all deliver rates.  

International - For deliveries outside of the US, please note that any import duties/taxes or other fees levied by your local custom authorities are the sole responsibility of the buyer.  

Please note that any additional duties/taxes assessed by your local authorities are in addition to the price paid on the platform.  We do not collect any of these fees when you place an order.  You may be able to recoup import fees assessed by your local customs.  Please contact your local custom authorities for information.  

The delivery time for your order will depend on your delivery country and time spent in custom.  Unfortunately we cannot provide an estimate for how long your order will take to clear customs.  However, you may contact your custom authorities for such information.  For international deliveries, the estimated time of delivery (not including time in customs) is 5-8 business days.  

All International Delivery

For shipments from the US to the rest of the world, we will calculate the shipping fee at the time the order is confirmed.  Shipping fees are paid by the buyer.  Any import duties/taxes or other fees levied by your local custom authorities are the sole responsibility of the buyer. 

It is your responsibility to collect your package from the courier if delivery has been attempted and the courier is holding the parcel for your retrieval.  If you do not pick up your parcel and the package is returned to the seller, you are responsible for all shipping and handling charges incurred by us for the parcel return.  

For deliveries outside of the US, if the recipient refuses delivery of their order due to any assessed custom charges, your package will be considered abandoned and disposed of by the delivery carrier.  Consequently your order is not eligible for any refund.  

Once your order has been shipped, you will receive delivery information which can be used to track your parcel.  We are unable to guarantee an exact delivery date or provide any additional tracking information beyond that provided by the carrier.   

For our security control purpose and to mitigate any fraudulent transactions, we are only able to ship to the address provided at checkout, which must match the billing address with your credit card issuer.   Any orders with different shipping and billing addresses will not be processed.  

Your shipment does not include insurance.  

For international deliveries, please note, we have no control over the time needed for your package to clear customs in your delivery country. 

Once an order has shipped, it is no longer possible to cancel the order.  

 

SECTION 15 - LOST OR STOLEN PACKAGES

We are not responsible for packages that are lost or damaged in transit.  For lost or stolen packages, please contact the carrier to file any necessary claims.  

We are not able to reroute a package once it has shipped.

 

SECTION 16 - RISK OF LOSS

Risk of loss and title for items purchased from ROTATE pass to the buyer upon delivery of the items to the delivery carrier.  The buyer is responsible for filing any claims with the applicable carrier for damaged and/or lost shipments.  We will do everything within our power to assist you in your claim to the carrier.   

 

SECTION 17 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

 

SECTION 18 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.



SECTION 24 - PROHIBITED USES AND RESTRICTED ITEMS

ROTATE reserves the right to refuse any items from being listed on our website which we deem not appropriate for us as a brand and will determine what can be listed or not listed on the platform at any time.  We reserve the right to come to decisions on what we find offensive or inappropriate for us as a brand and do not have to provide any explanation to sellers on our decision.  

In addition to other prohibitions as set forth in the Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. In no case shall ROTATE, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
